Moore was first nominated to the United States Court of Appeals for the 6th Circuit by President Bill Clinton on September 14, 1994, to a seat vacated by Judge Robert Krupansky. Under Rule XXXI, paragraph six of the standing rules of the Senate, Moore's nomination was returned to the president on November 14, 1994. The ban is part of a sweeping measure restricting abortion procedures that has faced multiple legal challenges since it was enacted in 2020.
