When his mother became duchess of Cleveland and countess of Southampton in 1670, he was allowed to assume the name of Fitzroy and the courtesy title of earl of Southampton.

In addition to being the only son of Lord Charles FitzRoy, he was grandson of Augustus Henry FitzRoy – the 3rd Duke of Grafton and, for a short time, the Prime Minister of Great Britain (1768 to 1770). FitzRoy was educated at Harrow and joined the Royal Horse Guards at the age of 16.
